Senator Dino Melaye has been dealt another blow after a Kogi State High Court has struck out the assassination case he instituted against the chairman, Association of Local Government of Nigeria, Taofiq Isa.
Melaye, had on April 2017 approached the court over alleged assassination attempt on his life by Isa and four others – Ade Obege, Abdullahi Isah, Michael Bamidele and Ahmed Ajayi.
But in a ruling Tuesday, the trial judge, Fola Ajayi struck out the matter for want of diligent prosecution.
Ajayi lamented that despite four adjournments, the prosecution was not able to call their witnesses.
He however gave a consequential order for the prosecution to start their case afresh whenever they are ready.
Reacting on behalf of the defense counsels, Zakari Abbas commended the trial judge for the judgement.
Abbas said, “Hence, the charge brought against the defendants have been struck out. As it stands, there is no criminal charges against the defendants.
“However, he gave a consequential order that whenever they are ready with their witnesses, they could approach the court to start their case afresh.”
Melaye (APC, Kogi West) is presently in police custody after being picked up for charges of criminal conspiracy with a group of bandits in Kogi.
The embattled senator is being treated for injuries sustained when he tried to jump off a police vehicle last month.
